Mere fact that proponent of a will in a will contest served notice of intention to move for a new trial on opponent, but did not serve notice of any kind upon other defendants named in citation on filing of contest of the purported will, and did not serve heirs residing in the state with notice of intention to move for new trial, was not a fatal jurisdictional defect in view of fact that such other defendants did not appear at or before trial, and in view of fact that rights of such defendants could only be protected and secured by reversal of order appealed from.
