The appellant, Lavon Guthrie, alias, was convicted after a jury trial of the capital offense of murder of Rayford Howard committed during a robbery in the first degree or an attempt thereof, see § 13A-5-40(a)(2), Code of Alabama 1975. At the sentencing phase of the trial, the jury voted unanimously to recommend that Guthrie be sentenced to death. At the sentencing hearing held pursuant to §Â§ 13A-5-47 through -52, the trial court sentenced Guthrie to death by electrocution.
